Registration
1. Before you use and shop at shearbeauty.com you may choose to register with us.
2. You must be eighteen years of age or over.
3. You must ensure that the details you provide are correct and inform us immediately of any changes to your details.
4. You will be asked to enter you details and your own user name and password.
5. When you have registered with us we will set up your account.
6. To access your account you will need to enter your user name and password.
7. You will be responsible for all the activities in your account so you must keep your password confidential and secure.
8. If you believe someone else knows your password please change your password.
9. shearbeauty.com reserves the right to suspend or terminate your account immediately at our reasonable discretion or if you breach these Terms and Conditions.

Privacy Policy
10. Please make sure that you have read and understood our Privacy Policy which explains how we use, process and protect any information you provide to us in order for us to fulfil your order.

Prices
11. It is our intention to keep our website up to date and error free. Prices may change from over time and there may be occasions when prices are incorrect and differ from your previous order(s). Correct prices will be invoiced to you at the prices on the date when your order is ready for dispatch and confirmed on your delivery confirmation.
12. All prices include VAT.
13. Delivery charges are clearly highlighted throughout this website.
14. Promotions and prices you see in this website are not available at Stockists Salons and vice versa.

Availability
15. All goods are subject to stock availability.
16. This website is directed only at consumers accessing the website in the United Kingdom.

Ordering and Acceptance
17. All orders will be subject to our acceptance of the order.
18. You consent to us notifying you via your email address provided on registration about your order.
19. When you submit your order you will receive an automatic return email notifying you that we are processing your order.
20. We will then send you a second email acknowledging your order and your invoice with an estimated delivery time.
21. Please notify us immediately via email on info@shearbeauty.com if your order is incorrect or if you wish to cancel your order.
22. Your order will be accepted by us when we despatch the goods to you.

Payment
23. You can pay by debit card or credit card. We are sorry we cannot at this present time accept American Express.
24. Our liability to you will not exceed the total price charged for your order.

Delivery
25. Orders can only be delivered to an address in the United Kingdom. Overseas orders will not be accepted.
26. Delivery will be made to the delivery address completed by you when you order online.
27. If there is nobody at the delivery address when we attempt to deliver the order we may charge you an additional delivery fee if a time has been agreed.
28. Please refer to shearbeauty.com for details of types of delivery.
29. Whilst we endeavour to deliver goods on the day we specify, we cannot guarantee delivery on that day or accept liability if the delivery is made outside of the timescale given. If you require next day delivery please ensure that your order is placed before 2pm.
30. We cannot accept liability for any out of pocket expenses or other costs incurred due to failed delivery or delayed deliveries.

Returns Policy
We would like you to be happy with your purchase, however if you are dissatisfied:

31. Cancellation under the Cooling Off Period
a. You have the right to cancel your order within 7 working days after the date your order is delivered (cooling off period) by contacting our Returns Department via email on info@shearbeauty.com to specify what you want to return and your order number. For more information please refer to our Returns Procedure.
b. You do not have to give a reason if you cancel your order within the cooling off period.
c. You will be responsible for returning your order to us.
d. If you do not return the order we may arrange for collection. If so, we will deduct the costs of collection from your refund.
e. Please return the goods in their original condition you received the goods, unopened and unused.
f. We will refund you within 30 days of your notice of cancellation.
g. If there is no error made by us with your order, we will refund the cost of your order and the normal postage of delivery of your order.
h. We will not refund you the cost of returning your order.
i. We will not refund the cost of gift wrapping unless you return the order to us because it is damaged, defective or wrongly delivered (see paragraph 32 below).
j. For hygiene reasons, once packaging has been opened on certain products listed but not limited to the products below, we are, subject to our discretion, unable to offer a refund or exchange unless they are faulty or misdescribed. Colours may vary from the images displayed on our website.

32. Return of Damaged, Defective or Wrongly Delivered goods
a. If you return any goods in your order because it is damaged, defective or wrongly delivered, we will be happy to refund the cost of delivery of your order (including any gift wrapping costs and other services provided in connection with your purchase) and we will reimburse the costs of returning the goods to us.
b. Please return by contacting our Customer Service via email on info@shearbeauty.com

Returns Procedure
33. On contacting Returns Department via email on info@shearbeauty.com they will provide you with a delivery address to return the goods.
34. Please detach and forward the return form at the foot of the delivery note and send this with the goods you are returning.
35. On receipt of your returned goods and return form we will refund you monies in accordance with Returns Policy above.

Our Right to Cancel
36. Where prices are incorrect due to a typographical error in the pricing information we reserve the right to cancel your order.
37. We will not be held responsible for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure arises from any cause which is beyond our reasonable control.
38. We will notify you by email and will replace or refund any monies paid within 30 days of your order.

Intellectual Property

39. The entire content of this website including but not limited to images, illustrations, designs, icons, photographs and written materials is subject to copyright, trademarks and other intellectual property rights and is owned or controlled or licensed to Shear Beauty Limited.
40. You may only download or copy the materials on the website for the purpose of ordering the good from this website, but you are not entitled to copy, reproduce, transmit, display in public, create derivative works from or otherwise commercially exploit such materials.

Liability
41. Our liability for any claim for loss or damage arising from the use of this website or any information contained in any of the materials on this web site shall be limited to the sum paid by you for the relevant order.
42. We do not give any warranty or guarantee as to the accuracy of the content of this website and shall have no liability to you for any losses arising as a result.
43. The exclusions of liability set out in these terms and conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Shear Beauty Limited, or any of our employees or agents.
44. Where we provide any information supplied by a third party, we do not give any warranty or guarantee as to its accuracy or otherwise, and shall have no liability to you for any losses arising as a result.
45. To the full extent applicable by law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of this website.
46. The Shear Beauty website may include links to other websites or material which are beyond our control. When you activate any of these, you will leave the Shear Beauty website. We accept no responsibility or liability for the material on any website which is not under its control.

General
47. We reserve the right to amend these terms and conditions from time to time. We will notify you of any changes made to these terms and conditions by posting the changes on shearbeauty.com or by the email address you provided on registration. If you continue to use the website after the changes take effect you will be bound by the new terms and conditions.
48. We may transfer or assign our rights and liabilities referred to in these terms and conditions. You may not transfer any rights or liabilities arising out of your use of this website.
49. A person who is not party to these terms and conditions shall have no right to enforce any term under the Contracts (Right of Third Parties) Act 1999.
50. These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Where there is a dispute, you agree the dispute will be settled in the exclusive jurisdiction of the English courts.
